Clay Bennett's Attorney: Seattle is Scheming to Make Clay Bennett Sell

April 17, 2008 5:44 PM

Take a look at this legal document.

It's the latest battlefield in a widening legal war the owners of the Seattle SuperSonics and the various people working to keep the Sonics in Seattle.

Jim Brunner of the Seattle Times writes:

After a week of bad publicity, Sonics owner Clay Bennett is striking back -- accusing Seattle Mayor Greg Nickels in court documents of a "Machiavellian plan" to force Bennett and his fellow Oklahoma City-based owners to sell the team back to Seattle investors.

In a federal court filing, Bennett's lawyers also say Nickels' office concealed evidence that a proposed $300 million KeyArena expansion floated by the mayor would have cost more than that.

The document, from law firm Byrnes & Keller representing Bennett's Professional Basketball Club (PBC) claims, among other things, that the City of Seattle understands the current KeyArena lease is "dysfunctional." Then it goes on to say:

So why is the City seeking to specifically enforce the last two years of this admittedly dysfunctional lease agreement? Documents just obtained show that the answer has nothing to do with the last two years of the lease. Instead, the City is trying to exploit its landlord status to force the PBC to sell the team. This litigation and the recent media frenzy the City helped ignite are part of an agreed-upon strategy between the City and a potential purchaser of the Sonics. That strategy expressly views this litigation as a way to drive up costs for the PBC -- to increade the financial bleeding -- to try to force PBC to sell.

Much of the document is redacted, so it's hard to know exactly what's going on here.

But I'll tell you this much: the battle is more on than ever.

The certain winners? Any lawyers involved who are getting paid by the hour. Other winners? Way too soon to tell.
